General terms and conditions

§ 1 Scope of application, customer information

The following General Terms and Conditions (GTC) govern the contractual relationship between Air2live UG and consumers and companies who purchase goods via our shop. Contradictory conditions or conditions that deviate from our contractual conditions will not be recognised by us. First of all, however, there are 5 basic rules that have priority:

1.1 Corporations cannot buy from us on credit. Natural persons may do so by arrangement.

1.2 All discounts or commissions are forfeited if payment is overdue by more than 30 days.

1.3 Company shares are only valid once Air2live has been incorporated as a public limited company. Before that it is a gift without legal claim.

1.4 The contract language is German

1.5 These general terms and conditions are valid from 01.10.2021.

§ 2 Conclusion of contract

(1) The offers on the Internet represent a non-binding invitation to you to purchase goods.
(2) You can place one or more goods in the shopping basket. In the course of the ordering process, you enter your data and wishes regarding the method of payment, delivery modalities, etc.. Only when you click on the order button do you make a binding offer to conclude a purchase contract.

(3) With the confirmation of receipt or invoice sent immediately by e-mail, acceptance of your offer is also declared at the same time and the purchase contract is thus concluded.

§ 3 Customer information: Storage of your order data

Your order with details of the concluded contract (e.g. type of product, price etc.) will be stored by us. We will send you these terms and conditions on request. You can indicate this in the message field of an order. However, you can also call up the GTC at any time after conclusion of the contract via our website. As a registered customer, you can access your past orders via the customer log-in area (My Account).

§ 4 Customer information: Correction notice

You can correct your entries at any time before placing the order by pressing the delete key. We will inform you about further correction options on the way through the ordering process. You can also end the ordering process at any time by closing the browser window or the WebApp.

§ 5 Retention of title

The object of purchase remains our property until full payment has been made.

§ 6 Warranty

There are legal rights of liability for defects (warranty) for our goods. As we resell products from other suppliers 95% of the time, we have a guarantee towards our suppliers, i.e. if goods are in stock they will be exchanged immediately, if not, the customer may have to wait several weeks in the worst case, as most of our goods come from China. The customer only pays the return costs, i.e. we pay the delivery costs from China and also in Germany to the customer. The process will start as soon as the product is in our office and the damage has been assessed. All technical specifications are according to the manufacturer and Air2live does not assume any guarantee for this.

§ 7 Commercial place of jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is our place of business.

§ 8 EU Dispute Resolution

In accordance with the Regulation on Online Dispute Resolution in Consumer Matters (ODR Regulation), we would like to inform you about the online dispute resolution platform (OS platform).

Consumers have the possibility to submit complaints to the online dispute resolution platform of the European Commission at http://ec.europa.eu/odr?tid=321267567. You will find the necessary contact details above in our imprint. However, we would like to point out that we are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§9 Liability for the contents of this website

We are constantly developing the content of this website and endeavour to provide correct and up-to-date information. According to the German Telemedia Act (TMG) §7 (1), as a service provider we are responsible for our own information that we make available for use in accordance with general laws. Unfortunately, we cannot assume any liability for the correctness of all contents on this website, especially for those provided by third parties. As service providers in the sense of §§ 8 to 10, we are not obliged to monitor the information transmitted or stored by them or to investigate circumstances that indicate illegal activity.

Our obligations to remove information or to block the use of information according to general laws due to court or official orders remain unaffected even in the case of our non-responsibility according to §§ 8 to 10.
